L1ST is a residential real estate brokerage in Charlotte, North Carolina, and Mitch Boraski is its broker in charge. This Privacy Policy explains what personal information we collect through the Site and in the course of providing real estate services (the "Services"), how we use and share it, and the choices you have. By using the Site or the Services, you agree to this Privacy Policy.

1. Information We Collect

We collect information you choose to give us when you:

Submit a contact, consultation, home valuation, listing review or property inquiry form
Book an appointment through the Site
Request a market report, deal sheet, relocation analysis or other guide
Subscribe to email or text updates
Correspond with us by phone, email, text or chat

This may include your name, email address, phone number, mailing address, the address of a property you own or are interested in, your timeline and price range, and anything you write in a message to us.

Information collected automatically

When you visit the Site, we and our service providers automatically collect certain technical information using cookies, local storage, web beacons and similar technologies. This may include your IP address, device and browser type, operating system, the pages you view and how long you stay, the links you click, the website or search that brought you to the Site, and campaign identifiers in the address bar. We use this information to understand how the Site is used and to attribute inquiries to the marketing that produced them.

Information from other sources

We may receive information about you from public records, multiple listing services, social media platforms, data providers and referral partners, and combine it with information you have given us. We do not use any of this information to make decisions covered by the Fair Credit Reporting Act.

Communications and CRM records

When you contact us, we keep a record of the communication, including emails, text messages, call notes and appointment history, in our customer relationship management system so that we can follow up and provide the Services.

Send market updates, listing alerts and other marketing communications you have opted into

3. Use of Artificial Intelligence

We use artificial intelligence tools in parts of our business, and we think you should know how.

Content. Some articles, market summaries and marketing materials on the Site are drafted or edited with AI assistance. Market figures are checked against MLS data before publication.
Communications. AI tools may help draft or organize our responses to you. A person reviews substantive communications before they are sent, and any advice about buying or selling a specific property comes from a licensed broker.
Analysis. AI tools may help us analyze market data, prioritize follow-up and match properties to the preferences you share with us.
Your choices. If you would prefer that we not use AI tools in our communications with you, tell us and we will accommodate that request where we reasonably can. We do not use AI to make automated decisions that have a legal or similarly significant effect on you.

We do not sell your personal information, and we do not share it with third parties for their own marketing. We may share personal information with:

Service providers who operate the Site and our business on our behalf, including website hosting, customer relationship management, email and text messaging, appointment scheduling, analytics and advertising platforms. These providers may use your information only to provide services to us.
Our brokerage. L1ST Real Estate Group is affiliated with eXp Realty, LLC. Transaction records may be shared with eXp Realty as required for brokerage supervision and compliance.
Transaction parties, such as lenders, attorneys, inspectors, appraisers and other agents, when you engage us to buy or sell a property and the sharing is necessary to the transaction.
Professional advisors, including attorneys, accountants and insurers, when needed.
Authorities, when required by law, subpoena or court order, or to protect the rights, property or safety of L1ST, our clients or others.
A successor in the event of a merger, acquisition or sale of all or part of our business.

5. Advertising and Tracking

We use Google Analytics to understand Site traffic. We may also use advertising platforms such as Google Ads and Meta (Facebook and Instagram), which place tracking pixels on the Site to measure conversions and to show our advertising to people who have visited the Site or who resemble our clients. These platforms may combine information collected on the Site with information they hold about you under their own privacy policies.

You can opt out of interest-based advertising through the Digital Advertising Alliance at optout.aboutads.info and the Network Advertising Initiative at optout.networkadvertising.org, and you can manage ad settings directly with Google at adssettings.google.com and with Meta in your account settings.

6. Your Choices

Email. Click "unsubscribe" in any marketing email, or contact us. We may still send transactional messages about an active inquiry or transaction.
Text messages. Reply STOP to any text to opt out, or HELP for help. See Section 9.
Cookies. Most browsers let you block or delete cookies. Blocking cookies may affect how parts of the Site work.
Global Privacy Control. We honor browser-based opt-out preference signals such as Global Privacy Control where required by law.
Access, correction and deletion. You can ask us what personal information we hold about you, ask us to correct it, or ask us to delete it, by contacting us at the address in Section 12. We will verify your identity before acting on a request and will respond within the time required by applicable law.

7. Data Retention and Security

We keep personal information for as long as needed to provide the Services, to maintain our business records, and to meet legal obligations, including North Carolina Real Estate Commission record-keeping requirements for transaction files. Marketing records are kept until you opt out or until they are no longer useful. When you ask us to delete your information, we remove it from active systems; copies may persist in secure backups for a limited period and in records we are required to keep.

We use reasonable administrative, technical and physical safeguards to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

8. Children

The Site and the Services are intended for adults. We do not knowingly collect personal information from anyone under 18, and we do not sell or share the personal information of anyone under 16. If you believe a minor has provided us with personal information, contact us and we will delete it.

9. Text Messaging (SMS)

By submitting a form on the Site and ticking the consent box, you agree to receive calls and text messages from L1ST Real Estate Group about real estate services at the number you provide. Messages may be sent by automated means. Consent is not a condition of purchasing any property or service. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time or HELP for assistance. Carriers are not liable for delayed or undelivered messages. No mobile information, including phone numbers and SMS consent, will be shared with or sold to third parties or affiliates for marketing or promotional purposes.

10. Third-Party Sites

The Site may link to third-party websites, including listing portals, lender tools, video platforms and social media. We are not responsible for the content, privacy practices or security of those sites.

11. Privacy Rights Under State Law

Residents of California, Colorado, Connecticut, Texas, Virginia and other states with consumer privacy laws may have the right to know what personal information we collect and how we use and share it, to access and correct that information, to request its deletion, to opt out of the sale or sharing of personal information and of targeted advertising, and not to be discriminated against for exercising those rights.

We do not sell personal information. To the extent our use of advertising pixels is treated as "sharing" for targeted advertising under state law, you may opt out as described in Sections 5 and 6. To exercise any other right, contact us at the address in Section 12. You may designate an authorized agent to make a request on your behalf; we will ask the agent for proof of authorization and may ask you to confirm the request directly. If we deny a request, you may appeal by replying to our response, and we will explain the outcome. If your appeal is denied, you may contact your state attorney general.

For California residents, the categories of personal information we have collected in the preceding twelve months are identifiers, contact information, commercial information about properties you own or inquire about, internet activity on the Site, and inferences drawn from the above about your real estate preferences. We collect this information for the purposes in Section 2 and disclose it to the recipients in Section 4. We do not collect sensitive personal information as defined under California law beyond what you choose to provide in a message to us.
